Strategic Impaired Driving Defence. Proven Results.
Refusing to provide a breath sample.
Failing to provide a breath sample.
Refusing to comply with a lawful demand for a breath sample.
Regardless of how it is described, refusing or failing to provide a breath sample is considered a serious criminal offence in Canada. These cases are often highly fact-specific. They can depend on the particular circumstances of the police demand, whether the demand was lawful, whether the driver understood what was being asked of them, and whether there was a valid reason why the driver could not or would not provide a sample.
Police in Brampton and across the GTA frequently use roadside screening devices and approved breath-testing instruments when conducting impaired driving investigations. A person can still be charged with refusal even if there is no breathalyzer reading showing that they exceeded the legal limit. In some cases, individuals may be unable to provide an acceptable sample because of medical concerns, anxiety associated with the test, confusion about the process, limited English proficiency, respiratory issues, or other complications with the testing procedure.

Implications of Refusing a Breath Sample in Brampton
Serious consequences can arise immediately from failing or refusing to provide a breath sample. For example, in Ontario, if you are charged with refusal, you could lose your licence at the time of the stop, before your case is heard in court.
If convicted of a refusal charge, the minimum penalties can include a mandatory driving prohibition, a substantial fine, and a criminal record. Refusal charges can carry penalties as severe as, or in some cases greater than, those for impaired operation or driving with a blood alcohol concentration over the legal limit.
A refusal conviction can also result in additional provincial licensing consequences and requirements before you are permitted to drive again. Your insurance rates could increase significantly, and you may have difficulty obtaining standard coverage. You may also be required to install an ignition interlock device in your vehicle.
The consequences of this type of conviction can extend beyond the loss of your licence. A refusal conviction can affect employment, professional licensing, travel plans, and your personal reputation.
How We Defend Refusal to Provide a Breath Sample Driving Charges
In cases where you are accused of having refused or failed to give a breath sample (in Brampton or anywhere else in the GTA), the specific details surrounding how the police requested a breath sample will likely be critical. The specifics include what the officer requested you do; how he/she requested you to do so; how you responded; and if there was a legitimate reason as to why you could not reasonably produce a suitable breath sample.
Reviewing the validity of the breath demand:
The Crown must show that they had a lawful request for a breath sample. We review all aspects of events which led to the demand being issued; the grounds upon which the demand was issued; how the request was made; and whether all applicable requirements under law were met. If issues exist with the request itself then this may impact the Crown's overall case.
Determining whether there was a reasonable excuse:
There may be times when a person is physically incapable of producing a sufficient breath sample. Such examples may include medical conditions, difficulty breathing, excessive anxiety, physical injury, etc. As such, we review the evidence presented in order to establish whether or not there was a valid reason for your inability to produce a suitable breath sample.
Examining what happened during the testing process:
Just because a breath test resulted in failure does not necessarily mean that you deliberately refused. We review the number of tests attempted; the instructions provided by the police officers; the manner in which the testing equipment was utilized; and what the officer documented regarding each attempt at providing a breath sample. Any video tape recordings taken of the event(s) including any police reports/documents written by the officer may also be reviewed in establishing what did occur.
CHALLENGING POLICE PROCEDURES AND CHARTER VIOLATIONS
Police must follow legal requirements throughout an impaired driving investigation. We review the detention, access to legal counsel, breath demand, testing procedure, and other interactions with police. Where Charter violations or procedural problems occurred, the defence may seek to challenge the admissibility of certain evidence.

I went through one of the hardest times of my life when I was facing charges for assault, assault with a weapon, mischief, and uttering threats. I was stressed, scared, and didn’t know what was going to happen. Hiring Gurasish Pal Singh was the best decision I could have made. He was professional, calm, and really took the time to explain everything to me in a way I could understand. He was always responsive and picked up my calls whenever I needed answers or reassurance, which meant a lot during such a stressful time. His fees were also very reasonable compared to other lawyers I spoke with. Most importantly, he delivered results and he got all my charges dropped, and he also helped my friend with their case. I truly felt like he cared and worked hard for the best outcome. If you need a criminal lawyer in Brampton who is reliable, responsive, and knows what he’s doing, I highly recommend Gurasish Pal Singh. Thank you so muchPosted on Google![]()

I was facing very serious charges related to an incident involving a firearm and robbery, and both me and my family were very worried about what would happen. I hired Gurasish Pal Singh to represent me and he worked closely with my family from the start to put together a strong bail plan. He was able to get me released on bail on December 24th Christmas Eve which meant a lot to us. During the case, the Crown offered a resolution that would have left me with no criminal record, but Gurasish took the time to explain why I shouldn’t accept it and believed the case could be handled better. He stood by that advice and continued to push forward. The matter was set for a preliminary hearing, and in the end he was able to get the charges completely withdrawn. I’m very grateful for his work and would recommend him to anyone looking for a criminal lawyer who is dedicated and supportive.Posted on Google![]()
